A hundred cafes, bars, shops and businesses across Nottinghamshire have joined a campaign to show they 'remain inclusive' to transgender people after a recent controversial ruling.

The Pastel Project, an activist group that says it aims to 'make Nottingham a city of sanctuary for transgender people for the UK', has created the campaign in a bid to offer businesses guidance in the wake of a new legal verdict made on gender.

On Wednesday, April 16, five judges at the Supreme Court ruled that the terms 'woman' and 'sex' in the 2010 Equality Act refers to biological woman and biological sex.

The ruling means transgender women with a Gender Recognition Certificate - a Government-issued document issued after someone legally changes sex - can be excluded from single-sex spaces if "proportionate".

The case was brought against the Scottish Government by campaign group For Women Scotland, who argued that the use of single-sex spaces - including bathrooms and changing rooms - should be limited to those who are born female.

But transgender people and support groups argue this will have a negative impact on the safety of trans women. Businesses have also shared concerns about what the new ruling means in terms of legal guidance around the use of toilets and other single-sex spaces.

Sam Harvey, the director of The Pastel Project, says he created the 'Your Spaces Too' project to assist businesses during the period, but also to give them the opportunity to show they remain inclusive of the transgender community. "We’re giving bars and venues some clarity and some guidance," he said.

"Many businesses are worried these recommendations from the Supreme Court are unworkable. We're asking them to provide certain facilities for transgender people. Some places just have facilities such as stalls and urinals and that works fine.

"We’ve seen some amazing responses from local businesses and, if you walk around the city centre, you can see so many get involved. It's not just traditional LGBTQ+ spaces - so many people are onboard with this."

While not official legal advice, the activist group is offering policy recommendations and guidelines based on current UK statutes. The campaign has also led to stickers being handed to all businesses involved, which are then shown in windows at venues to clarify their position on the new ruling.

Sam adds the campaign has gone beyond Nottinghamshire and venues from as far as New York are getting involved. Brewdog, Broadway Cinema, Pitcher and Piano and NTU's student bars are among the most popular venues in the city that have joined the campaign.

A spokesperson from Broadway Cinema, one of the businesses involved in the scheme, said: "The Pastel Project’s Your Spaces Too campaign reflects our ongoing commitment to accessibility and inclusivity — values that lie at the heart of Broadway’s mission to inspire a lifelong love of film in everyone."

In a statement, a spokesperson for the Bunkers Hill pub in Hockley added: "We're proud to be a part of the campaign. We believe that everyone should feel safe, welcome and comfortable within our venue.

"We respect your right to use whichever facility you feel safest and most comfortable in. We strongly support the trans community's right to exist in peace."
